A Lusaka businessman has appeared in court facing multiple offences, including possession of a firearm without a licence and ownership of property suspected to be proceeds of crime.
Martin Mbaya, who is in his 50s, appeared before Lusaka Magistrate Paul Namakando facing five criminal charges.
In one count, it is alleged that on April 21, 2024, Mbaya had in his possession a 9 millimetre pistol without a licence and was also in unlawful possession of ammunition.
The accused, a reported Patriotic Front (PF) member and family associate of former president Edgar Lungu, is also accused of uttering false documents.
When the matter was called, State prosecutor Stuyvesant Malambo informed the court that the case had not yet been allocated to a prosecutor.
Magistrate Namakando urged the prosecution team to put its house in order, considering that the matter is before the time-bound Economic and Financial Crimes Court.
The case was adjourned to today for a status conference in readiness for a possible plea and trial.
In 2024, the Drug Enforcement Commission (DEC) arrested Mbaya for various offences.
In a statement, DEC public relations officer Allan Tamba said the accused was found in possession of a Toyota Land Cruiser reasonably suspected to be proceeds of crime.
It was also alleged that he had a Girsan pistol with 96 rounds of ammunition without holding a licence.
Mr Tamba further said that between January 2022 and April 21, 2024, Mbaya allegedly forged a firearm licence with intent to deceive, falsely purporting it to have been genuinely issued by the Lusaka City Council.
It is further alleged that the purportedly forged licence was uttered to DEC.

State to appeal sentence in Khadijah Agatha Mingel drug trafficking case

The National Prosecution Authority (NPA) intends to file an appeal against the sentence imposed on Kitwe-based businesswoman Khadijah Agatha Mingel, a Kitwe based businesswomen.
Khadija was yesterday convicted for drug trafficking after being found in possession of 500 grammes of cocaine, a serious offence under our laws.
But the State feels the three year jail term reduced to 18 months, through a suspension was too lenient and it will appeal against it.
“The appeal will challenge the leniency of the sentence imposed by the subordinate court.
The National Prosecution Authority has taken the view that the sentence imposed does not adequately reflect the seriousness of the offence,” NPA said in a statement.
NPA notes that drug trafficking remains a significant concern for law enforcement authorities, with dangerous narcotics increasingly finding their way into communities and contributing to addiction and related criminal activity.
The prosecution maintains that sentences imposed for drug trafficking offences must provide a meaningful deterrent in order to disrupt the illicit drug trade and protect the public.
“For this reason, the State will formally lodge an appeal against the sentence.
The matter will consequently proceed to the High Court, where the appellate court will consider the State’s arguments regarding the sentence imposed.
“The High Court will determine whether the sentence passed by the trial court was appropriate in the circumstances of the case, or whether it ought to be revised in accordance with the law,”
NPA adds that it has restated its commitment to ensuring that offences involving dangerous drugs are prosecuted firmly and that sentences imposed reflect the gravity of such crimes and their impact on society.

TO send a strong warning that Government will not condone abusive employers, Labour Commissioner Givens Muntengwa has recommended revocation of work permits for two Chinese filmed in a scuffle with a female employee, whom they pinned to the floor Zamfresh Company.
A video went viral in which two men are seen squeezing a woman on the ground in an office space which appeared locked.
Some people are heard calling on the duo to release the woman who was physically helpless as she was squeezed to the group.
Mr Muntengwa said the conduct of the two was unacceptable and should never happen again at any work place because such anarchy is against labour laws.
“We are recommending that their permits he revoked, because we don’t want you to create a narrative in the labour sector that what happened can happened can happen and can be done to any employee, we are saying no!,” he said yesterday when he met the employees at the company.
“…and we must send a strong signal and the strong signal is whoever does that must be kicked out of the country, we must get rid of bad elements in the labour sector, the labour sector is not for fights, stone throwing, hand panky, no! It’s for serious business,” he said.
Mr Muntengwa said employers and employees should always dialogue when resolving labour disputes-not getting physical.
“You have seen the way we have sat, talk about issues, resolve, jf someone has stolen, you bring evidence, the disciplinary Code that’s why we wanted it, it will show what follows, whether it’s a dismissal, that’s a process, someone runs away, there is an address, you can follow them,” he said.
A company representative acknowledged that the conduct of the two men on the female was was unfortunate and regrettable.
“What happened was so unfortunate that they had to touch her, the strangling was not good,” she said.
But she however said that that “the one who was assaulted[first] is actually a Chinese”.
However, Mr Muntengwa swiftly interjected and told her that that was not justifiable.
“No, no, no!….those(two) we are recommending, they will have to go back, we are recommending, and their work permits revoked, we don’t want, ever to see that again and we are sending a strong signal to everyone out there that it’s intolerable.
“Employees rights and places of work must be protected and you must be given a fair hearing if you have engaged in alleged misconduct,” he said.
Mr Muntengwa said “what they are doing is anarchy, to take the law into their own hands”

THE violent motorist of Ndola who was filmed kicking and punching a traffic police officer has been charged with three offences, including assault on a police officer.
Police have identified him as a doctor, of Ndola, Copperbelt , who initially told the victim during the altercation that he was a clinical officer.
The association of clinical officers recently distanced themselves from the suspect, Dr Emmanuel Njovu, who has now been slapped with three counts- assault on a police officer, disobeying traffic rules and dangerous driving.
This is according to a statement by police public relations officer Godfrey Chilabi.
Dr Njovu last Wednesday went viral on social media after being filmed flexing his muscles on a uniformed traffic officer, kicking and punching the law enforcer, until he lost balance and fell on his bottom.
“The suspect, Emmanuel Njovu, aged 32, a Medical Doctor based in Ndola, was formally charged and arrested with the following offences:
“Assault on a Police Officer, contrary to Section 250(b) of the Penal Code, Chapter 87 of the Laws of Zambia.
“Disobeying a Traffic Sign, contrary to Section 170 (1) (2) as read with Section 225 of the Road Traffic Act No. 11 of 2002; and
“Dangerous Driving, contrary to Section 155 (1) of the Road Traffic Act No. 11 of 2002,” Mr Chilabi said.
He said the matter has been processed for court through the National Prosecution Authority (NPA).
“The suspect remains in police custody and is expected to appear in court soon,” he said.
And Mr Chilabi have an update on the case of child stealing at Kafue General Hospital.
“In relation to the case of child stealing that occurred at Kafue General Hospital in Kafue District on February 21, 2026, the Zambia Police Service has constituted a task team of investigators who are currently conducting investigations.
“No arrests have been made at this time.
The Service appeals to members of the public who may have credible information,” he said.
